Limitations of Liability

1. Scope of Services
OpenView Solutions LLC (“OpenView Solutions,”
“we,” “us,” or “our”) provides accessibility evaluation
and reporting services intended to assist
businesses in identifying potential website
accessibility issues. Our services are informational
and technical in nature and are not legal services or
legal advice.
We do not guarantee compliance with any specific
law, regulation, or standard, nor do we guarantee
avoidance of lawsuits, claims, or enforcement
actions.
2. Limitation of Liability
To the maximum extent permitted by applicable law,
OpenView Solutions LLC’s total liability for any
claim, loss, or damages arising out of or relating to
our services shal be limited to the lesser of:
• The total amount paid by the user for the
specific service giving rise to the claim, or
• One hundred fifty dolars ($150)This limitation applies per incident, regardless of the
number of claims asserted.
3. Excluded Damages
To the fulest extent permitted by law, OpenView
Solutions LLC shal not be liable for any:
• Lost profits or lost revenue
• Indirect, incidental, special, consequential, or
punitive damages
• Business interruption
• Loss of data
• Emotional distress
• Reputational harm
Even if we have been advised of the possibility of
such damages.
4. Third-Party ServicesOur services may reference, rely upon, or interact
with third-party tools, platforms, plugins, hosting
providers, or other services. OpenView Solutions
LLC is not responsible for the acts, omissions,
errors, outages, or failures of third-party services,
and any resulting issues are the responsibility of
those third parties.
5. No Warranties
Al services are provided “as is” and “as available.”
We expressly disclaim al warranties, whether
express or implied, including but not limited to:
• Accuracy or completeness of reports
• Fitness for a particular purpose
• Legal compliance
• Specific outcomes or results
6. User Responsibilities
Users are solely responsible for:• Backing up their own data
• Maintaining account security
• Implementing any recommendations provided
• Ensuring compliance with al applicable laws and
regulations
Unauthorized use, misuse, or use of our services
outside their intended scope voids any liability on
the part of OpenView Solutions LLC.
7. Exceptions
Nothing in this policy limits or excludes liability for:
• Gross negligence
• Wilful misconduct
• Fraudulent activity
Where such limitations are prohibited by law,
applicable consumer protection laws shal prevail.
8. Governing LawThis Limitation of Liability Policy shal be governed
by and construed in accordance with the laws of
the State of Kansas, without regard to conflict-of-
law principles.
9. Dispute Resolution
Before initiating formal proceedings, the parties
agree to attempt informal negotiations in good
faith.
If the dispute is not resolved within 30 days, it shal
be settled by binding arbitration, unless prohibited
by applicable law.
10. Severability
If any provision of this policy is found to be
unenforceable or invalid, the remaining provisions
shal remain in ful force and effect.11. Acceptance
By accessing or using our services, you
acknowledge that you have read, understood, and
agreed to this Limitation of Liability Policy.
Continued use of our services constitutes
acceptance of this policy.
